So I shot over to the farmer's house that has a big 485 A in the corn field. He was wrenching on his tractor trailer and I asked him the big question.

"We launch our parachutes off big structures and are interested in that big tower you have there. Theres a possibility that we'd land in your land and would like to know if that would be ok?" Blah blah blah....

He flashed a big smile and said all that stuff about being crazy. He said he'd have no problem with it as long as our families wouldnt sue him if we got hurt. He asked if we could write up something to "hold him harmless" in case something happens. He gave me his name and number.I was just going to do the normal routine and 2am it, but I have to cut right accross his front door and I figure I'd take a shot at getting a day jumper.

I'm brainstorming wasy to satisfy him and not admit to trespassing on the tower.

"I hold (Farmer's name) harmless in the event I become injured within 1 mile of "farmer's address." ???????????????????????????

Ummm... Why on earth would you set conditions such as the 1 mile? Shouldn't it just be a blanket release of liability?

Maybe you could get in touch with one of the Bridge Day organisers and obtain their waiver plus their permission to use it for your jump?

In the absence of that, I would use different language. Holding somebody harmless is commonly used in cases where somebody (i.e. you) undertakes to hold the indemnified person (i.e. the farmer) harmless against any damage or claim the indemnified person faces because of something (i.e. your jump). I.e. if a third party makes a claim against the farmer, you would undertake to pay him the loss that he sustains because of that claim.

Furthermore, I would set out the time, location and the event more precisely in order not to expand your potential liability unnecessarily. Otherwise, you might end up having to hold the farmer harmless after he broke his foot because of kicking you from his premises because you where trying to date his daughter after the jump.

I guess what you are looking for is a waiver instead of a hold harmless undertaking. You could write something like "I, <name> intend to jump from the <whatsoever tower> located <address>. <farmer's name> has given his consent to my jump. I hereby agree not to make any claims against <farmer's name>, his employees or his family if I or any property of mine should suffer any harm, injury or damage due to this jump." You could add something like "In case any property of <farmer's name>, his employees or his family should be damaged due to this jump, I agree to compensate the relevant owner of the property."

This is pretty rough and dirty, but could be a start. I assume that the jump will be legal. In some jurisdictions, getting the farmer's consent will not be sufficient to make the jump legal, so you might want to check that. Of course, I would only put something in writing in case the jump was legal.

You could also try to get hold of a waiver from a dropzone and try to tailor it to your needs.

    Have fun!

Oops, shit, I should have read your post more carefully. Forget what I wrote above about checking whether the jump is legal.

    Slightly different wording:

"I hereby agree not to make any claims against <farmer's name>, his employees or his family if I or any property of mine should suffer any harm, injury or damage while I am on <farmer's name> land, <address>." Again, you could add something like "In case any property of <farmer's name>, his employees or his family should be damaged due to me being on <farmer's name> land <address>, I agree to compensate the relevant owner of the property."

Still far from perfect, but better than my above proposal.

However, you are creating a perfect piece of evidence with your name and potentially your address on it in case you are seen and somebody talks to the farmer.

Why do landowners always assume they'd be liable if you got hurt jumping on their property? I haven't heard of any jury awarding damages in a case like that. Hell, I've never lost a minute of sleep thinking that a jumper would sue me for a Bridge Day injury or fatality. Personal responsibility. And if any of you want to come jump the 50' chimney on my house, I won't make you sign a waiver.

Mike, if you want a copy of the BD waiver, just let me know. Of course, I get to come jump the tower w/ you.

Just jump it in the day so all the neighbors will call the cops then you put the landowner in heat. What, you scared of the dark? Oh yea, the video camera will not record at nite. Then how will you be a rockstar on Youtube?
The farmer dosen't own the tower. He does collect a check from the company for the land use. The tower company will be pissed to find out from the authorities there are people tresspassing on their property (the tower); Potentially losing a much needed subsidy to their agricultural business, the farmer has shot himself in the foot. Plus, if you die, you think that paper will protect the landowner? He is now fucked, plus if the police are pressuring him (or you for that matter), you think that paper will show up. That shit is going in the trash can Jump it. Be quiet. Have fun-

Haze, twoply is probably one of the last people I can think of who would care about daylight jumping for the purpose of getting video and being a youtube rockstar. Sometimes it's nice to just have a relaxed daytime object that you can jump without all the sneaking, darkness, and being tired at work the next day. The ninja aspect of jumping is fun, for sure, but nothing beats a nice day-jumpable object with a low bust factor and a friendly farmer to share a 6-pack with while you pack for another jump in their backyard.

Besides, unless you know the tower involved, it's kind of silly to assume that he didn't think of the neighbor factor. If it's a farm, there's a good chance that it's pretty remote.

i have close to a hundred daytime jumps off a similar tower. the farmer and his kids that live on the land are cool and occasionally come out and watch us jump. everyone wins. the best part is that they let us park at the house. don't be jealous, daytime jumps are fun! i have an equal amount of night jumps off of it as well, but sometimes on occasion i like to sleep at night.

i also used to work on towers and i rarely did work on them at night. so if the weather was nice, guess what... i dayblazed the shit out of those too, with my boss shooting video.
